The case comes down to the claim that a locally cultivated product that is used domestically rather than sold on the open market is not subject to federal regulation. Given the CSAs findings and the undisputed magnitude of the commercial market for marijuana, Wickard and its progeny foreclose that claim. Vacated and remanded.Then comes the Opinion of the Court. I think delivered by one Justice and joined by the others in the majority. Then comes one or more concurring statements. And finally the also interesting dissenting opinions. Sometimes the dissenting Justices join; sometimes they write their own separate dissents. This Gonzales v. Raich case is unusually longer than others I've read. Plus it's interesting to note that all three dissenting Justices are considered conservatives. They must have had a hearty debate. |
